Teckal Exemption

A procurement exemption allowing an authority to award directly to an entity it controls, provided the control and activity conditions are met.

A public procurement exemption derived from the Teckal Srl v Comune di Viano judgment of the Court of Justice of the European Union (Case C-107/98). The exemption permits a contracting authority to award a contract directly to an entity it controls, such as an in-house company, without conducting a competitive procurement, provided the statutory conditions relating to control and the entity’s activities are satisfied. The Teckal principles have subsequently been incorporated into UK procurement legislation.
